What Mediation Is
A creative problem-solving process
An opportunity to create workable agreements
A transformative process for individuals to help create a happier healthier life
Redefines relationships and encourages win-win vs. win-loose
A process that uncovers "all the things" that you might not have known you'd have to think about in the midst of a conflict.
Creation of plans surrounding each item in a patient manner
Cost effective - not using lawyers to create agreements can save lots of money
Fast & Flexible - Getting into court to resolve disputes can take time and require tight schedule constraints
Can be a preventative process addressing conflict before it arises so there is a concrete plan in place to alleviate stress when life happens
No-pressure, non-binding agreements
An informal process
Confidential
Surrounded by the values of Respect, Responsibility and Relationships
A voluntary process for all parties
An improvement over what already exists
Parties are in charge of the product, while the mediator is in charge of the process
Also can be referred to as ADR (Alternative Dispute Resolution)
What Mediation Is Not
Mediation (me-di-a-tion) is not meditation (med-i-ta-tion)...Sorry, I can't help you with proper breathing techniques but that is important to keeping calm
Mediation is not arbritration. No one person decides the outcome for you
Mediation is not one attorney for 2 people. In fact, there is oftentimes no attorney involved in the process
Not to decide fault or blame
Not to decide punishment and consequences
Not for dropping of charges or court orders
Not an "if....then" situation
Not to decide contingincies
Not to decide "winner vs. loser"
Not a place to seek legal advise
Not a mandated process
